Prosecutor for the State assisted by counsel for the complainant. Perused the order impugned and the police investigation diary.
There are serious allegations against the petitioner that he embezzled a sum of Rs.12,77,920/-. In my view, in such matters, a custodial interrogation is necessary. Hence, no case for anticipatory bail under section 438 Cr.P.C. is made out.
The bail application filed by the petitioner under section 438 Cr.P.C. is, therefore, dismissed.
