Appellant No.2 Parmanand being convicted by
Court of Session preferred appeal and this court while admitting his appeal passed order of 29th suspension of sentence on October, 2002.
Petitioner submitted his bail bonds, but it appears that later on matter riped up for hearing and neither petitioner nor his counsel appeared and despite hearing was postponed/adjourned, when 6th no one appeared on April, 2007, the court considered appropriate to forfeit bail bonds and summoned petitioner by non-bailable warrant. In pursuance of said order, accused-appellant No.2 was arrested and produced before court on 25th
May, 2007, but no application was filed on his behalf for bail. As such, he was sent to judicial custody. He is now in judicial custody since May, 2007.
In the interest of justice, this court considers appropriate to suspend the sentence of accused-petitioner Parmanand provided he furnishes a personal bond in the sum of
Rs.50,000/- [Rupees Fifty thousand only] together with one surety in the like amount to the satisfaction of trial court for his appearance before this court on 11/12/07 and on all dates of hearing unless otherwise directed.
