Prosecutor for the State. Perused the order impugned and the police investigation diary.
The allegation against the petitioners is that they were in possession of poppy straw and by seeing the police party, they threw the bag containing poppy straw and fled away.
The petitioners were identified by police constables Raj Mal and Hari Singh. In this view of the matter, in my view, it is not a fit case to grant anticipatory bail to the petitioners.
The bail application filed by the petitioners under section 438 Cr.P.C. is, therefore, dismissed.
