This is an unusual petition filed by son [petitioner] assailing order dated 2nd November, 2006 whereby learned trial Judge while allowing the application filed by his parents u/s.125
Cr.P.C., awarded Rs.2,000/- towards maintenance to be payable to the parents.
Undisputedly, petitioner is one of sons of respondent Nos.2 & 3 and he is in government service. Learned trial Judge after taking into consideration the material on record, considered appropriate to award a sum of Rs.2,000/- towards maintenance to parents who are very old and depended upon him.
It is otherwise true that in old age, it is expected that their children will give them financial support, but as I have already observed that this is an unusual situation that parents have to be compelled to file application for seeking maintenance from their children.
This court has gone through the order impugned and finds no substance to interfere.
Consequently, the misc. petition fails and is hereby dismissed. [AJAY RASTOGI],J.
