By an application being Cr.Misc. Application No.743/2006 and the instant criminal misc. petition under section 482 Cr.P.C., learned counsel Mr. Jagjeevan
Chand Bhandari submits that he has represented the non-petitioner in
S.B.Cr.Misc. Petition No.879/2004, which came to be decided on 21.8.2006 along with S.B.Cr.Misc. Petition No.329/2004, but his presence has not been marked in the order dt. 21.8.2006 though he was present and argued the matter. This fact has not been disputed by counsel for the petitioner Mr. B.R.Mehta.
In the circumstances, therefore, it appears that due to oversight/typographical error, the name of the counsel for the non-petitioner Mr.
Jagjeevan Chand Bhandari has not been shown in the order dt. 21.8.2006 and, therefore, in order dt. 21.8.2006 just after the name of counsel for the petitioner, the word "Mr. Jagjeevan Chand Bhandari, for the non-petitioner" is incorporated and it is made clear that the counsel for the non-petitioner Mr. Jagjeevan Chand
Bhandari appeared and argued the matter.
The Criminal Misc. Petition under section 482 Cr.P.C. as well as the application being Cr.Misc. Application No.743/2006 are accordingly disposed of.
