Heard counsel for the petitioner, Sri Suresh Singh Standing Counsel and perused the record.
The petitioner, an employee in the Department of Family Welfare (Health) of Nagar Nigam, Kanpur Nagar, had retired on 28.2.2002. From Annexure 4 to the writ petition it appears that the petitioner has not been paid his Provident fund, Gratuity, Leave Encashment, Group Insurance, Difference of 5th Pay Commission, Difference of D.A. & Pension of 9 months.
By means of this writ petition, the petitioner has sought for a writ in the nature of mandamus commanding the respondents to pay his post retiral benefits amounting to Rs. 4,18,000/- towards Provident fund, Gratuity, Leave Encashment, Group Insurance, Difference of 5th Pay Commission, Difference of D.A. & Pension of 9 months.
An ad-interim mandamus is issued to the respondents to pay the aforesaid amount of the petitioner within a period of six weeks from today or show cause by filing counter affidavit within the same period.
List this case immediately after expiry of the aforesaid period.
