Heard learned counsel for the applicants, learned Addl. Government Advocate for the State and perused the record.
It is contended by the learned counsel for the applicants that the property in dispute is the ancestral and joint property. There is no apprehension of breach of peace. By producing the wrong facts, an ex-parte order of attachment dated 30.7.2004 has been passed. The order was stayed by the revisional court vide order dated 11.8.2004, but the revision was dismissed on 3.7.2005 and the stay order came to an end. His contention is that in compliance of order dated 30.7.2004, the property in dispute has not been given in the supervision of another person and the applicants are in possession over there according to their share.
Considering the facts and circumstances of the case, issue notice to opposite party no.2 to 4 returnable within four weeks.
List on 19th October, 2005.
Till then the order dated 30.7.2004 if not given effect shall not be executed and the status quo be maintained.
