Prashant Kumar Dubey v. State Of U.P. & Others - WRIT - A No. 35871 of 2005 RD-AH 3079 (19 September 2005)
Hon'ble A.P. Sahi,J.
Heard learned counsel for the petitioner and learned Standing Counsel for the respondents.
In spite of time having been granted on 4.5.2005, no counter-affidavit has been filed on behalf of respondents.
The petitioner claims to have a merit index of 276.72 for his claim to be sent on training to the special BTC training course conducted by the respondents. The petitioner's claim has been ignored in spite of the fact that the code of merit declared by the respondents in the category in which the petitioner claims admission is 262.53. The petitioner contends that he is of Male Art Freedom Fighter category and, as such, the inaction on the part of the respondents in not extending the aforesaid benefit to the petitioner is wholly unjustified. In the circumstances of the case as indicated herein above, the petitioner shall approach the respondent no.2 along with a certified copy of this order who shall consider the claim of the petitioner and pass appropriate orders as expeditiously as possible preferably within a period of one month from the date of production of the certified copy of this order before him.
With the aforesaid observations, the writ petition is disposed of.
