We have heard Shri  Rajeev Mishra, learned counsel for the petitioner  and  have perused the  writ petition.

It has been  submitted by Shri Mishra that  against  the order enhancing  the load  and bill  the petitioner has preferred  an appeal before the  Deputy General Manager City Electricity Distribution Division, Allahabad, respondent no.2. The contention is that the appeal is not being  entertained on the ground that  the petitioner has  not deposited the amount.

This Court  in civil misc. writ petition no.35260 of 2003 M/s. Vardhaman Industries Works & another vs. U.P. Power Corporation Limited & others  decided  on 19.8.2003 has held that under  paragraph 7.20 of the U.P.  Electricity  Supply Code, 2002 there is  no pre-requirement of the deposit  of the amount in question if  order against which the appeal has been preferred has been passed by the Executive Engineer  Urban Distribution Division II which means  Executive Engineer ( Distribution) relying upon its earlier judgment and order dated 7.8.2003 passed in civil misc. writ petition no.34058 of 2003 M/s. Maurya Panels (P) Ltd. & another vs. U.P. Power Corporation Ltd. & others.  

We dispose of the writ petition in  terms of the observations made in the  aforesaid two judgments. The appeal be decided in accordance with law.
