The petitioner has been dismissed from service, after full fledged departmental inquiry. The appeal and revision have also been dismissed. The contentions raised by the petitioner involve disputed questions of fact and appreciation of evidence which cannot be gone into in this writ jurisdiction. The petitioner may approach the State Services Tribunal if so advised. Petition is liable to be dismissed on the ground of alternative remedy. It is accordingly dismissed.
In case the petitioner files claim before the Tribunal within one month from today, the Tribunal shall decide the same on merits ignoring the delay in filing the same as the petitioner had filed writ petition before this Court in 2001 and the same was pending, expeditiously within a period of 6 months from the date of filing of the claim petition.
