The applicant had challenged the order passed by this Court on 16.12.2004 by way of Special Appeal No. 11/05. The appeal has also been dismissed. The petitioner had thereafter filed Special Leave Petition before the Hon'ble Supreme Court which has also been dismissed. Subsequent thereto the petitioner filed criminal contempt petition no. 54937/05 for initiating contempt proceedings against the petitioner on the ground that petitioner has filed a forged order of the Basic Shiksha Adhikari in the writ petition decided on 16.12.2004. The Criminal Contempt petition so filed has been rejected by the Court on the ground that the petitioner can initiate contempt proceedings only with the leave of the court or with the leave of the Advocate General. Hence the present application.
In the opinion of the court since the writ petition has already been decided by this Court the order stands affirmed up to the Hon'ble Supreme Court it would be appropriate that the petitioner may apply for leave to the Advocate General.
Application is therefore, dismissed.
