This petition has been filed for quashing the select list dated 28th October, 2005 relating to appointment of Operators of Kisan Sewa Kendra in so far as it relates to the petitioner.
Learned counsel for the petitioner has contended that the respondent no.2 was wrongly shown to have secured more marks than the petitioner as a result of which he has been placed at Serial No.1 whereas the petitioner has been placed at Serial No.2.
From the records we find that the petitioner has already moved a representation dated 11th November, 2005 before the Indian Oil Corporation regarding the grievances raised in the present petition. Learned counsel for the Indian Oil Corporation has stated that the said representation shall be decided expeditiously and so this petition should not be entertained at this stage.
Having heard the learned counsel for the parties we are of the opinion that as the representation is pending disposal, the petition should not be entertained at this stage. We, however, direct that the representation dated 11th November, 2005, a copy of which has been annexed as Annexure ''4' to the petition, shall be decided expeditiously preferably within a period of four weeks from the date a certified copy of the order is produced by the petitioner before the Senior Divisional Manager, Indian Oil Corporation, Marketing Division, Allahabad. Needless to state that the said representation shall be decided after affording opportunity to respondent no.2, Pawan Kumar Yadav.
The petition is accordingly disposed of.
