Petitioner, who is working as senior Stenographer in the office of Additional Labour Commissioner-I (Establishment) U.P., Kanpur, is aggrieved by an order dated 30th November, 2005 whereunder seniority list of the Stenographers working in the pay scale of Rs. 4500-125-7000 has been published. In the said seniority list one Sri Ashok Kumar Bajpai has been placed at serial no. 44 while the petitioner has been placed at serial no. 64. According to the petitioner Sri Ashok Kumar Bajpai is junior to him and therefore the gradation list so published is not correct.
It is not necessary to enter into the merits of the claim set up by the petitioner inasmuch as under the impugned order dated 30th November, 2005 liberty has been granted to all the persons concerned to file objection, if any, against the gradation list, within 15 days.
In view of the aforesaid it is provided that the petitioner may file his objections with regards to seniority list published under the order dated 30th November, 2005 within 10 days from today along with certified copy of this order. On such representation being made, the Additional Labour Commissioner- I (Establishment) U.P., Kanpur shall consider the same strictly in accordance with law and shall decide the objection by means of a reasoned speaking order, preferably within four weeks thereafter and in any case before any further promotion is granted from the cadre in question. If necessary, Sri Ashok Kumar Bajpai may also be heard before decision on the objections of the petitioner.
Writ petition stands disposed of.
