The fair price shop licence of the respondent no. 4 was cancelled on 3.6.2003. Thereafter petitioner was appointed as a licensee in place of respondent no. 4 on 21.2.2005. The respondent no. 4 filed an appeal against the said order which was allowed on 27.3.2006 and thereafter licence of the petitioner has been cancelled on 2.5.2006, hence, the present writ petition has been filed.
We have heard counsel for the petitioner, the Standing Counsel and Sri T.R. Gupta for the respondents.
The petitioner was appointed as a licensee of a fair price shop in place respondent no.4. The licence of the respondent no. 4 has been restored. There is no illegality in the order darted 2.5.2006. However, the petitioner has filed Civil Misc, Writ Petition no. 21456 of 2006 against the order dated 27.3.2006. In case any interim order is granted in the said writ petition or ultimately that writ petition is allowed, it would be open to the petitioner to file an application seeking modification of the order in terms of the order passed in that writ petition.
With these observations, the writ petition is dismissed.
