This is an application for bail moved on behalf of the applicant Maluva indicted in case crime No. 42 of 2006 under section 307 I.P.C. P.S. Soron District Etah.
Heard Shri S.S. Chauhan, learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that according to the injury report the gun shot injuries are simple in nature. The learned counsel submitted that incident is said to have taken place in the darkness of night at 1.30 A.M. but no source of light has been mentioned in the First Information Report.
The learned A.G.A. submitted that specific role of opening fire has been assigned to the applicant. The injuries caused by fire arm are on the vital part of the body i.e. chest.
I have taken into consideration the submissions advanced on behalf of both the parties.
According to the injury report the injuries are simple in nature. Looking to the nature of injury, I consider it to be a fit case for bail.
Let the applicant Maluva indicted in case crime No. 42 of 2006 under section 307 I.P.C. P.S. Soron District Etah, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
