This is an application for bail moved on behalf of the applicant Mahesh Singh indicted in case crime No. 90 of 2005 under sections 25 Arms Act P.S. Thariyawn District Fatehpur .
Heard Shri B.S. Rathore, learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that applicant has been granted bail by an order dated 19.5.2006 passed in Criminal Misc. Bail Application No. 3709 of 2006 Mahesh Singh Vs. State of U.P. The learned counsel submitted that the recovery of illicit weapon used in the crime under section 302 I.P.c is said to have been made from the possession of the applicant.
The applicant having been granted bail in main case crime no. 89 of 2005 under sections 147, 148, 149, 302, 504, 506 I.P.C. and 7 Criminal Law Amendment Act, he is entitled to bail in the present case.
Let the applicant Mahesh Singh indicted in case crime No. 90 of 2005 under sections 25 Arms Act P.S. Thariyawn District Fatehpur, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
