This is an application for bail moved on behalf of the applicant Shiv Singh indicted in case crime No. 35 of 2006 under sections 363, 366, 376 I.P.C. P.S. Tajganj District Agra.
Heard Shri M.K. Shukla, learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel submitted that no allegation of rape has been made against the applicant. The learned counsel urged that the victim went away with co-accused of her own freewill and consent.
The learned A.G.A. submitted that applicant and co-accused took away the girl on motorcycle which belonged to the applicant.
I have taken into consideration the submissions advanced on behalf of both the parties.
No allegation of sexual assault has been made against the applicant. The applicant is said to have left the victim and co-accused Pawan at bus stand. The co-accused is said to have committed rape. Looking to the role assigned to the applicant, I consider it to be a fit case for bail.
Let the applicant Shiv Singh indicted in case crime No. 35 of 2006 under sections 363, 366, 376 I.P.C. P.S. Tajganj District Agra be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
