Learned counsel for the petitioner submits that an order under Section 122-B (4-F) was passed in favour of the petitioner on26.8.1989 against which a revision was filed by Udai Raj father of respondent no.2 which was allowed by order dated 8.8.2001 by the Commissioner, Basti Division, Basti. This order according to the petitioner's counsel was an exparte one and an application for setting aside the order has been filed by the petitioner which is pending before the Commissioner, Basti Division, Basti and no orders being passed thereon. Counsel for the petitioner submits that the Commissioner be directed to dispose of the application filed by the petitioner expeditiously and within a time bound period.
Having heard counsel for the petitioner, standing counsel and counsel for Gaon Sabha this writ petition is disposed of with the direction to the Commissioner, Basti Division, Basti to dispose of the application filed by the petitioner for setting aside the order dated 8.8.2001 expeditiously and if possible within a period of six months from the date a certified copy of this filed before the Commissioner. It is made clear that no opinion upon the merit of the petitioner's case has been expressed by this court and the Commissioner will pass appropriate orders in accordance with law.
