Learned cousnel forthe petitioner urged that plotno.43 was situatedin frong ofhis residentialhouse and itis through this plotthat the petitioner is havingegress and ingress. He also urged that C.O.and s.O.C.allotted this plot considering the above aspects and recorded a categoricalfinding while Deputy Director Consolidation reversed the finding withoutconsidering the relevant aspects.

Inview of averments made in para 15 of the writ petition,itis directed that operationof the order dated 21.12.2005 passed by D.D.C. (Annexure 5 tothe writ petition) shall remain stayed till next listing.
