Heard learned counsel for the applicant and learned A.G.A.
It is contended by the learned counsel for the applicant that the applicant is the husband of the daughter of the opposite party no. 2 there is dispute between the husband and the wife. The allegations made against the applicant are false and frivolous. It is further contended that some positive efforts should be made to reconcile the matrimonial relations of the husband and wife.
Learned A.G.A. prays for and is granted 4 weeks time to file counter affidavit.
Issue notice to opposite party no. 2 returnable within a period of four weeks
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and learned A.G.A. it directed that the applicant shall deposit a sum of Rs. 8000/- in the court of learned Chief Judicial Magistrate, Farrukhabad. The amount so deposited shall be handed over to opposite party no. 2. In case the aforesaid amount is deposited, the further proceedings in Criminal Case No.165 of 2005, pending in the court of learned Chief Judicial Magistrate, Farrukhabad shall remain stayed till the next date of listing.
