Gaya Din v. A.D.J.Ii Allahabad - WRIT - C No. 14116 of 1981 RD-AH 12267 (26 July 2006)
Hon'ble S.U.Khan J
Heard learned counsel for the petitioner.
Suit being O.S. No. 136 of 1972, Brij Lal and others Vs. Gayadin filed by the original respondents was decreed on 30.1.1976 by VI Additional Munsif Allahabad. Suit was decreed for Rs. 1350/-. Thereafter execution was filed which was allowed on 16.2.1979. Against the said order Civil Revision No. 134 of 1979 was filed which was dismissed by II A.D.J Allahabad on 10.8.1981.
Learned counsel for the petitioner states that in pursuance of order passed in this writ petition on 9.8.1982 directing the petitioner to deposit decreetal amount and in pursuance of the said order decreetal amount has been deposited on 10.1.1983.
I do not find any error in the impugned judgment and orders. Moreover decreetal amount has also been deposited.
Accordingly writ petition is dismissed.
Let the decreetal amount deposited by the petitioner be withdrawn by the respondents/ legal representatives of respondents. No further execution proceedings need be taken.
