HIGH COURT OF JUDICATURE OF ALLAHABAD

Hon'ble R.K. Agrawal, J.

Hon'ble Vikram Nath, J,

Shri M.C. Tripathi appears for the respondent.

The contention of the petitioner is that the Court of ACMM/ Addl. Civil Judge (SD), Kanpur Nagar, where his suit is pending, is lying vacant for the last three months, as a result of which, the petitioner is unable to file any application for redressal of his grievances.

In this connection, the petitioner may approach either the Civil Judge, Senior Division or the District Judge, Kanpur Nagar for taking steps to get the case transferred to some other Court which is functioning, if the Court of ACMM/ Addl. Civil Judge (SD), Kanpur Nagar, where the suit of the petitioner is alleged to be pending, is lying vacant for the last three months as alleged.

The writ petition is disposed of with the aforesaid observations.
