Heard learned counsel for the applicant and learned A.G.A. for the State and perused the FIR.
The applicant is said to have picked up the pocket of the informant at the Railway Station. He was chased by the informant and, with the help of two constables of G.R.P., was arrested on the spot. It is further urged that no purse/looted cash was recovered from the possession of the applicant. The applicant was sent to jail on 24.6.2006.
Having considered all facts and circumstances of the case and the fact that the purse was not recovered from the possession of the applicant, I am inclined to release the applicant on bail.
Let the applicant-Mohd. Azeem be enlarged on bail on his executing a personal bond and furnishing two sureties, out of which one would be a member of the family of the applicant, each in the like amount to the satisfaction of C.J.M., Saharanpur in Case Crime No. 104 of 2006, under Section 379 I.P.C., Police Station G.R.P., District Saharanpur.
