This application is filed by the applicants with a prayer that a direction may be issued the courts below so that the property of the applicant may not be attached in the proceedings under Section 83 Cr. P. C.
It is contended that the some other c0-accused were involved in case crime no. 200 of 2005, under Section 363 and 366 I.P.C. In that case he has not surrendered in the court The proceedings of attachment have been initiated by the court concerned , but the applicant is having apprehension of attachment of his property, whereas he is not accused in that case.
Considering the facts and circumstances of the case and submissions made by the learned counsel for the applicant the learned Magistrate concerned is directed that he shall proceed under Section 83 Cr. P. C. in accordance with the provisions of law.
With the above direction the application is finally disposed of.
