It is submitted by learned counsel for the applicant that applicant is not named in the F.I.R. The F..R. was lodged after recovery of dead body. During investigation the name of the applicant and co-accused Budh Pal Singh alias Rajeshwar came into light. Co-accused Budh Pal Singh alias Rajeshwar has been released on bail by this court on 13.6.2006 in Crl Misc Bail Application No. 7583 of 2006.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Omvir singh involved in Case Crime No. 329 of 2005, under Sections 302and 201 I.P.C Police Station Khudaganj, District Shahjahanpur be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
