Mahendra Singh v. D.D.C. & Others - WRIT - B No. 61280 of 2005 RD-AH 14513 (28 August 2006)
Civil Misc. Writ Petition No. 61280 of 2005
Deputy Director of Consolidation, Bulandshahr and others
Hon'ble Krishna Murari, J.
Heard Sri Mahendra Singh, who appears in person.
By means of this writ petition, the petitioner has challenged the order passed by the Deputy Director of Consolidation on an application moved by him seeking injunction against the respondents restraining them from transferring the property in dispute. Certified copy of the order impugned in the writ petition has not been filed. The petitioner was given number of opportunity to file certified copy of the order but the same has not been brought on record. However, in the interest of justice, I have examined the copy of the order, which has been passed on the margin of the application filed by the petitioner, annexed as Annexures ''1' and ''2' to the writ petition. The Deputy Director of Consolidation has recorded that dispute is pending before the Consolidation Officer where the petitioner can approach. I find no illegality in the impugned order. Even otherwise an application seeking injunction cannot be filed before the Deputy Director of Consolidation, without any proceedings being pending before him..
The writ petition fails and is hereby dismissed.
