Heard learned counsel appearing on behalf of the parties.
Learned counsel for the contesting respondent raised an objection that the present writ petition being second writ petition against the recovery of same loan, is not maintainable. To this, learned counsel for the petitioner submitted that this writ petition may be treated as application in the earlier writ petition, which has been disposed of by this Court vide its order dated 12th July, 2006.
Considering the facts and circumstances of the present case as also in the interest of justice, I direct that the deposit of the instalment in terms of the order dated 12th July, 2006 is extended to the extent that for the instalment which the petitioner was supposed to be deposited by 15th August, 2006, now the petitioner will deposit a sum of Rs. 60,000/- (sixty thousand) by 7th of September, 2006 and the balance amount will be deposited by 7th of December, 2006. The rest terms and conditions will be same as earlier ordered by this Court vide its order dated 12th July, 2006
With the aforesaid direction, this writ petition is finally disposed of.
