Heard learned counsel for the applicant and the learned A.G.A. and Sri V.K. Jaiswal, learned counsel for the complainant.
It is submitted by learned counsel for the applicant that the applicant is Jeth of the deceased. The cause of death is burning. He was living separately about three years prior to the alleged occurrence from the deceased . He was having no concerned with the family affairs of the deceased and her husband. He has no concerned with the demand of dowry and subjecting the deceased with curtly. The case of the applicant is distinguishable with the case of the husband of the deceased.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Ram Pal involved in case crime no. 93 of 2006 under Sections 304,498-A I.P.C., and section ¾ D.P.Act P.S. Hapur Dehat District Ghaziabad be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
