Heard learned Counsel for the applicant, learned A.G.A.
It is submitted by learned counsel for the applicant that the alleged occurrence had taken place in the night of 14.6.2006 at about 3.00 a.m. It is alleged that the applicant and co-accused Jitendra discharged the shots, consequently, the deceased received injury, but during investigation it has been specifically alleged that co-accused caused injuries on the person of the deceased. According to the post mortem examination report the deceased had received only one lacerated wound allegedly caused by co-accused.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Subhash Yadav involved in Case Crime No. 588 of 2006, under Section 302 I.P.C. Police Station Chauri Chaura, District Gorakhpur be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
