Heard learned Counsel for the applicants and learned A.G.A.
It is submitted by learned counsel for the applicant that the applicants are not named in the F.I.R. There is no direct eye witness account. The case is base on circumstantial evidence. The only allegation against the applicants is of extra judicial confession which has been recorded after two months of the alleged occurrence.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicants and without entering into the merits of the case, the applicants are entitled to be released on bail.
Let the applicants Hari Singh and Ramautar involved in Case Crime No. 112 of 2006, under Sections 302 and 201 I.P.C. Police Station Massoorie District Ghaziabad be released on bail on their furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned .
