The argument of learned counsel for the applicant is that the applicant is not named in the F.I.R. and if any act was committed it was Raghavendra Singh.
Learned counsel for the opposite party has submitted that the applicant was sitting on the tractor when it was recovered. He has also not shown the sale letter of the tractor showing that he had purchased the tractor from Raghavendra Singh. Considering this I find it a fit case for bail.
Let applicant Chandra Bhan Sharma be released on bail, in Case Crime No. Nill of 2006, under sections 41,411, I.P.C, Police Station Kotwali, District Azamgarh, and case crime No.513 of 2006, under Sections 406,409,419, 420,467,468 and 471 I.P.C, Police Station Sidhari, District Azamgarh on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the c ourt concerned.
