Chandrapal v. Dy. Director Of Consolidation (Bareilly Camp) Badaun & Ors. - WRIT - B No. 48811 of 2006 RD-AH 15466 (6 September 2006)
Civil Misc. Writ Petition No. 48811 of 2006
Chandrapal vs. Dy.Director of Consolidaiton, Budaun & others
Hon'ble Krishna Murari, J.
Heard learned counsel for the petitioner.
The facts as set out in the writ petition are that the petitioner purchased various lands during consolidation proceedings by means of three different sale deeds. After his name came to be mutated in the revenue record on the basis of sale deed, he filed an objection before the Consolidation Officer for consolidating all the lands purchased by him in one chak. The said objection was dismissed by the Consolidation Officer though the copy of the said order has not been filed along with the writ petition. Appeal filed by the petitioner was also dismissed. Again copy of the appellate order has not been filed with the writ petition. Thereafter, the petitioner filed a revision which has also been dismissed. The revisional court while dismissing the revision has recorded a finding that since the proceedings of chak allotment are over as such it is not possible to allot all the lands purchased by the petitioner in one chak.
In my opinion, no illegality has been committed by the Deputy Director of Consolidation and there is no scope of interference in the impugned orders.
The writ petition accordingly, fails and is dismissed.
