Supplementary is being filed by the learned counsel for the appliocant.
It is submitted by learned counsel for the applicant that in the present case the applicant was released on bail, but due to some unavoidable circumstances he could not appear in the court, so his bail has been cancelled. He undertakes that he shall appear in the court concerned till the conclusion of the trial. He is in jail since 17.4.2006.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Mahendra Singh involved in Case Crime No. 229 of 1994, S.T. No. 811 of 1995, under Section 302 I.P.C. Police Station Jahangirabad, District Bulandshahar be released on bail on his furnishing a personal bond and two heavy sureties each of the like amount to the satisfaction of the Court concerned with the condition that the applicant shall report to the police station concerned in the first week of each month about his behaviour and conduct till the conclusion of the trial. It shall be open to the learned C.J.M. concerned to cancel the bail of the applicant, if it is reported otherwise by the S.O. of police station concerned and the applicant shall not tamper with the evidence.
In default of the above condition the bail granted to him shall be deemed cancel.
