Accused applicant Sabir has prayed for release on bail in case Crime No. 564 of 2005 under Section 383/ 411 IPC, P.S. Kavinagar, District Ghaziabad.
Heard learned counsel for the parties and perused the record.
According to prosecution case accused and two others were seen by the complainant and others taking Cooler, Cooler Stand and the iron window on Rickshaw and when challenged they ran away and accused applicant and one more co accused were apprehended by the people who had collected there in a sugar cane field.
Learned counsel for the accused applicant has contended that accused has been falsely implicated in this matter and F.I.R. was also lodged under Section 307 IPC but after investigation alleged firing was not found to have taken place and accused have been charge sheet under Sections 382, 411 IPC. He has further contended that the sister of the applicant has been married in the village of the complainant and on account of some ill-will he has been falsely implicated.
Considering the facts and circumstances of the case, accused applicant is entitled to bail.
Let the accused applicant named above involved in above noted case Crime be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
