This is an application for bail moved on behalf of the applicant Shahid Khan indicted in case crime No. 160 of 2006 under sections 498-A, 307, 324, 504, 506 I.P.C. and section 3/ 4 of Dowry Prohibition Act P.S. Parikshitgarh District Meerut.
Heard Shri Satyendra Kumar Singh, learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that First Information Report was lodged two days after the incident and medical examination was conducted on 5.6.2006. The learned counsel argued that injuries are of simple nature. The learned counsel submitted that applicant and co-accused were bringing the complainant to marital home after compromise, therefore, there was no occasion for subjecting her to assault.
The learned A.G.A. argued that there was demand of cash of Rs. two lacs. The learned counsel submitted that specific allegation of tying the neck of the complainant with her Duppata has been made against the applicant.
I have taken into consideration the submissions advanced on behalf of both the parties.
The injuries are of simple nature. The applicant is in jail for the last about one and half months. In view of these facts, I consider it to be a fit case for bail.
Let the applicant Shahid Khan indicted in case crime No. 160 of 2006 under sections 498-A, 307, 324, 504, 506 I.P.C. and section 3/ 4 of Dowry Prohibition Act P.S. Parikshitgarh District Meerut , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
