Heard Sri Subhash Gosain, learned counsel for the applicant, learned A.G.A. and perused the record.
According to prosecution case Jeep No. UP 62 K 1514 with Engine No. AC 40672 and Chesis No. 42 L 25338 belonging to the informant was stolen on 10.5.2005. Subsequently, accused was found in possession of this stolen vehicle on 26.5.2005 at 12.45 p.m. when he was using it as Taxi.
Learned counsel for the accused applicant has contended that the applicant has been falsely implicated as he is a poor man and he did not pay heed to the demand of the Police personnel and therefore he has been falsely implicated but the allegations as made in para-8 of the affidavit are very vague. Accused was found driving the stolen vehicle after about 15 days of the incident and there is not ground to release him on bail.
In the circumstances of the case accused is not entitled to bail and his application is liable to be rejected and is hereby rejected.
