It is submitted by learned counsel for the applicant that the applicant is Jeth of the deceased. The cause of death is hanging and the marriage of the deceased was solemnized on 19.2.2001. The applicant was living separately from the deceased and her husband. He was having no concerned with the family affair of the deceased. His case is distinguishable with the case of the husband of the deceased.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Sundar alias Shyam Sundar Gupta involved in Case Crime No. 405of 2006, under Sections 498-A and 304-B I.P.C. and Section ¾ Dowry Prohibition Act, Police Station Maruwadeeh District Varanasi be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
