Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that in the present case the F.I.R. has been lodged against the applicant on 21.5.2006 on the basis of doubt and suspicion in respect of the incident which had occurred on 23.5.2006 at about 10.00 or 11 a.m. The dead body of the deceased was recovered from district Mathura on 24.5.2006 as unknown person. During investigation the I.O. recorded the confessional statement of the applicant. His name has been disclosed by the co-accused also. It is alleged that when he was taken on police remand he has been shown the place where the deceased was murdered. There is no other evidence against the applicant.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Pravesh alias Parvej involved in case crime no. 130 of 2006 under Sections 364,302 and 201 I.P.C., P.S. Gonda District Aligarh be released on bail on his furnishing a personal bond and heavy sureties each in the like amount to the satisfaction of the Court concerned.
