This is an application for bail moved on behalf of the applicant Raj Kumar involved in case Crime No. 337 of 2006, under section 2/3 of U.P. Gangsters and Anti Social Activities (Prevention) Act, 1986, Police station Nigohi, district Shahjahanpur.
Heard Sri Radhey Shyam Shukla, learned counsel for the applicant, learned AGA and have perused the record.
The learned counsel for the applicant submitted that four cases have been shown against the applicant in the gang chart and the applicant is on bail in all the cases shown in the gang chart.
The learned AGA contended that criminal history shown in the gang chart is of heinous offences and in case of release on bail there is every likelihood of applicant committing other offences of serious nature.
I have taken into consideration the submissions advanced on behalf of both the parties.
The applicant having been enlarged on bail in all the cases shown in the gang chart, I consider it to be a fit case for bail.
Let the applicant Raj Kumar involved in case Crime No. 337 of 2006, under section 2/3 of U.P. Gangsters and Anti Social Activities (Prevention) Act, 1986, Police station Nigohi, district Shahjahanpur, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned and an undertaking that he will not misuse the liberty of bail by indulging in the commission of crime or anti social activities after being released on bail.
