Heard learned counsel for the applicants and the learned A.G.A.
It is submitted by learned counsel for the applicants that the applicants are the father in law and mother in law of the deceased. The marriage of the deceased was solemnized about 5 years prior the alleged occurrence. There are general allegation against the applicant and other co-accused person. The F.I.R. of this case has been lodged after the cremation of the dead body. It is said that the applicants are living separately. They have no concerned with the family affairs of the deceased and her husband. The case of the applicants is distinguishable with the case of the husband of the deceased.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicants are entitled to be released on bail.
Let the applicants Samrath Singh and Smt. Ishwari Devi involved in case crime no. 599 of 2006 under Sections 498-A,304-B, 201 I.P.C., and ¾ D.P.Act P.S.Kalpi District Jalaun be released on bail on their furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
