Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant has not caused any injury on the person of the deceased. It is said that he was a member of the conspiracy. The applicant is aged about 76 years old. The case of the applicant is distinguishable with the case of the other co-accused.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Mehfooz involved in case crime no. 290 of 2006 under Sections 147,148,149,302,120-B I.P.C., and 7 Criminal Law Amendment Act P.S. Bilariaganj District Azamgarh be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
