This is an application for bail moved on behalf of the applicant Ashok Chaudhary involved in case Crime No. 204 of 2006, under section 3 (1) of U.P. Gangsters and Anti Social Activities (Prevention) Act, 1986, Police station Mahuli, district Sant Kabeer Nagar.
Heard Sri D. K. Srivastava, learned counsel for the applicant, learned AGA and have perused the record.
The learned counsel for the applicant submitted that four cases have been shown in the gang chart against the applicant in which he has been enlarged on bail. Co-accrued Riyazullah alias Raju has been granted bail by an order of this Court dated 11.9.2006 passed in Criminal Misc. Bail Application No. 18289 of 2006.
The learned AGA argued that the applicant is a man of criminal antecedents and in case of his release on bail there is likelihood of repetition of commission of other offences.
I have taken into consideration the submissions advanced on behalf of both the parties.
The applicant having been enlarged on bail in the cases shown in the gang chart, I consider it to be a fit case for bail.
Let the applicant Ashok Chaudhary involved in case Crime No. 204 of 2006, under section 3 (1)of U.P. Gangsters and Anti Social Activities (Prevention) Act, 1986, Police station Mahuli, district Sant Kabeer Nagar, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned and an undertaking that he will not misuse the liberty of bail by indulging in the commission of crime or anti social activities after being released on bail.
