This is an application for bail moved on behalf of the applicant Bhola Pal involved in case Crime No. 196 of 2006 (S.T.No. 485 of 2006) under sections 364-A, 364, 368, 120-B, I.P.C., Police station Kotwali, district Fatehpur.

Heard Sri D.K. Singh, learned counsel for the applicant, Sri Ram Bhawan, learned counsel for the complainant, learned AGA and have perused the record.

The learned counsel for the applicant submitted that the only allegation against the applicant is that the victim was kept at his residence in the night between May 17/18, 2006. The learned counsel submitted that recovery of the victim was not made from the possession of the applicant. According to the learned counsel the applicant surrendered before the court. The learned counsel urged that co-accused Sunil Kumar Mishra, Anshu alias Abhishek Kumar Rai who are the abductors have been granted bail by an order of this Court dated 19.9.2006 passed in Criminal Misc. Bail Application No. 17214 of 2006.

The learned AGA and learned counsel for the complainant submitted that the victim was kept at the residence of the applicant after abduction.

I have taken into consideration the submissions advanced on behalf of both the parties.

The victim was not recovered from the custody of the applicant. The victim in his statement gave out that he was kept for a night at the residence of the applicant. No demand of ransom was made by the applicant. In view of these facts, I consider it to be a fit case for bail.

Let the applicant Bhola Pal involved in case Crime No. 196 of 2006 (S.T.No. 485 of 2006) under sections 364-A, 364, 368, 120-B, I.P.C., Police station Kotwali, district Fatehpur, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
