This is an application for bail moved on behalf of the applicants Ram Dev Kewat, Babbu Kewat, Dinesh Kewat and Babli Kewat involved in case Crime No. 7 of 2006 under sections 147, 148, 149, 364, I.P.C., Police station Mau, district Chitrakoot.
Heard Sri Harish Chandra Mishra, learned counsel for the applicants, learned AGA and have perused the record.
The learned counsel for the applicants submitted that witnesses Bacholi and Ganesh made a belated disclosure about the circumstance of applicants taking away the dead body of the victim towards Mohra Ghat. The learned counsel submitted that there is no previous criminal history of the applicants no. 2 to 4.
The learned AGA argued that co-accused Gulab Kewat took away the victim to Kashi Nath Ka Purwa where the applicants were present with arms since before. The learned counsel argued that the applicants and co-accused committed the murder of the victim in Arhar field of Ram Singh Kewat and caused disappearance of the dead body by throwing it in Yamuna River at Mohra Ghat.
I have taken into consideration the submissions advanced on behalf of both the parties.
The witnesses Ganesh and Bacholi made disclosure on 27.1.2006 about the circumstance of having seen the applicants and co-accused taking away the dead body towards Mohra Ghat , therefore, I consider it to be a fit case for bail. l.
Let the applicants Ram Dev Kewat, Babbu Kewat, Dinesh Kewat and Babli Kewat involved in case Crime No. 7 of 2006 under sections 147, 148, 149, 364, I.P.C., Police station Mau, district Chitrakoot, be released on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
